Accident Waiver and Assumption of Risk * Check All Boxes RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT: I, the undersigned, hereby acknowledge and agree to the following terms and conditions regarding my participation in any and all activities associated with the renting and riding of a personal watercraft and other vehicle/accessories (hereinafter referred to as the "Activity"): ASSUMPTION OF RISKS AND FINANCIAL RESPONSIBILITY: I understand and voluntarily assume all risks and financial responsibilities associated with my participation in the Activity. These risks may include, but are not limited to, those arising from negligence, carelessness, dangerous equipment, defective property, or the possible liability of persons or entities associated with the Activity. I certify that I am physically fit and have adequately prepared or trained for participation in this Activity. I have not received advice from a qualified medical professional advising against my participation due to health-related reasons. WAIVER DISCHARGE AND RELEASE OF LIABILITY: In consideration of my participation in the Activity, I hereby release, waive, and discharge from any and all liability, including liability arising from negligence, the following entities or persons: Waver Rider, its affiliates, owners, and employees. I also agree to indemnify, hold harmless, and promise not to sue the entities or persons mentioned above from any liabilities or claims that may arise as a result of my participation in the Activity, whether caused by their negligence or otherwise. EXCLUSION OF RESPONSIBILITY FOR THIRD PARTIES: I acknowledge that any third parties involved in conducting specific activities on behalf of the event holders, sponsors, or organizers are not responsible for any errors, omissions, acts, or failures to act. ACKNOWLEDGMENT OF RISKS: I understand that the Activity may involve physical and mental challenges that carry the potential for death, serious injury, and property loss. Risks associated with activities such as Jet Skis are inherent to participants and volunteers alike. CONSENT TO MEDICAL TREATMENT: I consent to receive medical treatment that may be deemed advisable in the event of injury, accident, and/or illness during the Activity. USE OF LIKENESS: I acknowledge that I may be photographed or recorded during the Activity. I grant permission for my photo, video, or likeness to be used for legitimate purposes by the Activity holders, producers, sponsors, organizers, and assigns. BROAD CONSTRUCTION OF AGREEMENT: I understand that this Release of Liability and Assumption of Risk Agreement shall be interpreted broadly to provide a release and waiver to the maximum extent permissible under applicable law. FINANCIAL RESPONSIBILTY FOR EQUIPMENT: I agree to assume financial responsibility for the repair or replacement of any equipment, including but not limited to Jet Skis, Sea Doos, life jackets, ropes, and trailers, as determined by Wave Rider, its employees, owners, affiliates, or parent companies. I consent to providing payment information to Wave Rider for such purposes and assume all legal, collection, and attorney fees associated with the collection of insufficient funds or any unpaid amounts.
